Commissioner Decisions On Lead Agency Disputes

In a coordinated review under SEQR, there are times when the involved agencies are not able to agree which one of them will become the lead agency. When this happens, any of the involved agencies or the project sponsor can request the Commissioner of the Department of Environmental Conservation to designate a lead agency [See 617.6(b)(5)]. The decisions of the Commissioner are organized by the type of project that was the subject of the dispute and by date of issuance. Questions regarding lead agency disputes should be directed to Regional Support Section, Division of Environmental Permits.
